CONCLUSION

 

The City of Regina’s Real Estate Branch proposes to close and consolidate a portion of the rights-of-way with the adjacent lands located at 625 (Block 19), 715 (Block 18), and 815 (Block A) Dewdney Avenue. The closed portion of the rights-of-way are to be consolidated and redeveloped as two separate sites (future Blocks E and F).  Existing buildings on these sites are planned to be demolished to accommodate subsequent redevelopment in accordance with the requirements of Regina Zoning Bylaw No. 9250 (Zoning Bylaw). 

 

The portion of rights-of-way proposed to be closed are not currently used by the travelling public or service providers and therefore, the proposed closure will not impact vehicular traffic or pedestrian movement in the area. Accordingly, the Administration recommends approval.

 

BACKGROUND

 

A closure application has been submitted concerning the rights-of-way adjacent to 625, 715 and 815 Dewdney Avenue.

 

This application is being considered pursuant to the Zoning Bylaw, Design Regina: The Official Community Plan Bylaw No. 2013-48 (OCP), The Planning and Development Act, 2007 and The Cities Act, 2002.

 

A related subdivision application is being considered concurrently by the Administration, in accordance with Subdivision Bylaw No. 7748, as amended, by which subdivision approval authority has been delegated to the Administration. A copy of the plan of proposed subdivision is attached for reference purposes as Appendix A-3.

 

DISCUSSION

 

The City’s Real Estate Branch proposes to close and sell a 4,784 m² portion of right-of-way consisting of portions of Atkinson Street, an unnamed lane & Broder Street and consolidate these portions of rights-of-way with the adjacent properties located at 625 (Block 19), 715 (Block 18) and 815 Dewdney Avenue (Block A) as shown in Appendix A-1 and A-2. 

 

The resulting block configuration is identified on the plan of proposed subdivision in Appendix A-3. The subdivision will result in the creation of two new Blocks including Block E (41,139 m² in area) and Block F (5,993m² in area).  Each of these resulting properties will receive new addresses following subdivision approval.

 

The existing buildings on site are planned to be demolished with both resulting Blocks E and F being redeveloped in the future.  Given the presence of exiting buildings on site, the certificate of subdivision approval will not be issued by Administration until demolition permits have been issued and executed for the removal of the buildings. Future development will be reviewed in accordance with the requirements of the IT - Industrial Tuxedo Park Zone under the Zoning Bylaw. 

 

The portion of rights-of-way to be closed have never been developed as physical roads and lane. As such, the legal closure of these rights-of-ways will not impact vehicular or pedestrian movement in the area.

 

Surrounding land uses include a variety of industrial land uses.

 

RECOMMENDATION IMPLICATIONS

 

Financial Implications

 

The sale price for the portion of road/lane is $309,000 plus GST. Proposed Lots E and F, which include the portion of the closed rights-of way, will result in a modest increase in the property tax assessment attributable to the property owner. The closure of the rights-of-way will relieve the City of Regina of any obligations for its maintenance or physical condition. The applicant will be required to grant all necessary easements or pay the cost associated with utility relocations where required.

None with respect to this report.

 


Policy/Strategic Implications

 

The proposal is consistent with the policies contained within the OCP with respect to the community goal of achieving long-term financial viability. By divesting itself of an unused portion of road right-of-way, the City of Regina has ensured that there will not be any long-term financial implications associated with the land. 

 

The portions of right-of-way to be closed are not required for traffic circulation purposes.

The application was circulated to the Heritage Community Association (HCA). Following circulation, the Administration attempted follow up contact with the HCA, but did not receive a response prior to the deadline for submission of this report.

 

The applicant and other interested parties will receive a copy of the report and notification of the meeting to appear as a delegation in addition to receiving a written notification of City Council’s decision.
