ISSUE

At its meeting on May 18, 2022, City Council approved amendments to The Community Standards Bylaw No. 2016-2 (the Bylaw) during consideration of item CR22-63. The Bylaw Enforcement Branch is seeking to add some additional bylaw amendments relating to temporary fences for unsecured buildings.

 

IMPACTS

The impacts related to these additional amendments are consistent with those outlined in the City Council report CR22-63.

DISCUSSION

The proposed amendments will give bylaw enforcement officers (BEOs) the authority to order a property owner to erect a temporary fence around their property for security purposes where structural issues prevent the property from being boarded. Temporary fences that are erected under these circumstances should be limited to the same 90-day period that boarded properties are currently subject to under the Bylaw for consistency. After the 90-day period has elapsed, a temporary fence will be deemed a nuisance if it is not removed, the same as would occur for boards that are not removed from a house within this timeframe. This will help facilitate timely compliance and allow BEO to escalate these matters more easily where compliance does not occur.

The height restrictions that normally apply to fences in the front yard of a property will not apply to temporary fences that are ordered to be erected for security purposes. The increased height is needed for adequate security and will only be allowed on a short-term basis (90 days) to minimize the aesthetic impact it has on the community.

 

DECISION HISTORY

At its meeting on May 18, 2022, City Council considered item CR22-63 and adopted a resolution to concur in the recommendation contained in the report.
